Planning Board Minutes Thursday March 22, 2012
Members present: Maggie Leonard, chair, Larry Klein, and Stephen Enoch.
The meeting was called to order at 7:15 (we waited to see if Barry might come). The minutes from the March 8th meeting were read. The minutes were approved as amended.
Larry Klein conferred with the board regarding his task as the Wired West representative to get contact information for private roads that are governed by associations and are not town roads. In order for Wired West to go forth and wire western Massachusetts they need to get contact information for permission to work on the poles in the right-of-way of private roads. Klein had contacted the Assessor’s Office and the Tax Collector but they had no database with that information.
Klein met with the Registrar of Deeds in Great Barrington, Wanda Beckwith, and she said that only state agencies would have that information because they collect taxes (the implication being that the associations are taxed).
Maggie updated to board on the public hearing scheduled for Monday April 2, 2012. She reported to the board that Mark Bobrowski would not be able to attend, but that he would be at the informational meeting on Friday, April 27th and he would also attend the annual Town Meeting on May 5th. Leonard also said that she would email ZBA members about the public hearing.
Klein reported that he was invited to join the ZBA and wondered if it would be in conflict with his Planning Board duties. Enoch said that it did not seem inappropriate to him. Leonard said that there is no conflict but that Klein’s wife would probably object.
The board reviewed the record of the Gauthier Special Permit hearing. Enoch said he thought the problem with §IV.E Nonconforming Uses Structures and Lots, is that when a situation falls under §IV.E. 2.b. there is no criteria to be followed as there is in the next section, §IV.E. 2.c. Stephen thinks we might want to take this on next year.
The board reviewed and discussed the Remote Participation law recently adopted by the town. Klein asked if the Town has an telephone account that provides for conference calls, and said that we will also need an omni-directional speaker and microphones.
Klein asked about the progress of the two permitted cell towers in Monterey. Had anyone heard or seen anything on the 31 Main Rd. tower? Any buzz from Keswick? No one had any info. Klein said that there should be a provision where the applicants make progress reports on the stages of construction so that the Planning Board, the ZBA, the Select Board, and all citizens know what’s going on.
